Which types of proceedings in the Magistrates’ Courts are covered in the “Enquire Electronic Application for Court Records” function of the integrated Court Case Management System (“iCMS”)?

With effect from 30 December 2022, iCMS will be implemented for (a) Summonses including Departmental and Private Summons, Driving Offence Points Summons and Fixed Penalty Summons; and (b) Notices including Departmental Notice, Fixed Penalty Notice and Fixed Penalty Recovery Order in the Summons Courts of the Magistrates’ Courts.

Who can use the Enquire Electronic Application for Court Records function?

Individual User (“IU”) account holder and Organization User (“OU”) account holder (for Organization Account) who has submitted an electronic application for court records may enquire the application by means of iCMS.

Q3
Apart from OU account, there are Primary Administrator (“PA”) and Secondary Administrator (“SA”) accounts in an organization. Can a PA or an SA account holder enquire electronic application for court records by means of iCMS?

No. PA/SA has to create an OU account of his/her own before he/she can enquire the submitted electronic application for court records by means of iCMS.

How does an IU/OU account holder enquire electronic application for court records by means of iCMS?

To enquire the submitted electronic application for court records by means of iCMS, an IU/OU account holder is required to login his/her registered user account. Select “Magistrates’ Courts”“Inspection of Document”“Enquire Electronic Application for Court Records”, input case number or application reference number so required.

I have not submitted any electronic application for court records, can I make enquiry on the application submitted by others?

No. Only the IU/OU who has submitted an electronic application for court records can enquire their submitted application by means of iCMS.

What kinds of information are available upon making enquiry on submitted application by means of iCMS?

You may enquire the information of your application such as application reference number, case number, submission date/time, types of court records applied, status of application and fees of each court record, etc.

After your application is processed by the Court, you may enquire the updated status of your application. If your application is approved by the Court, you may enquire the fees of court records and proceed to payment by means of iCMS.

Is there any acknowledgement informing the applicant of any subsequent procedures after an application is processed by the Court?

Yes. A message including information such as application status and subsequent procedures required will be sent to the iCMS Message Box of IU/OU.

For example, IU/OU may need to provide information or supporting document(s) for replying requisition from the Court; provide response for the estimation of transcript of court hearing; make electronic payment for the fees of court records; or download the electronic copy of court records.

How long will the messages from the e-Court be retained in the Message Box under iCMS?

The messages will be retained in the Message Box for 28 days after they are read. Any unread message(s) will be deleted after 90 days from the date of message. You may print or download the messages for own retention and reference as you deem necessary.

Will there be emails reminding an IU/OU of the messages sent to his/her Message Box under iCMS?

As a default arrangement, a reminder notification will be sent to his/her registered email address at day-end each day when there is/are unread message(s) in his/her Message Box.

In addition, he/she may choose to receive individual email notification upon arrival of each message in his/her Message Box.

Can an IU/OU withdraw the electronic application for transcript of court hearing after he/she receives the estimation of fees for the transcript requested without withdrawing the whole application for other court records?

Yes. If he/she has indicated his/her preference to receive the estimation of transcript fees in the application, he/she may, by providing response to the estimation of transcript fees via the “Enquire Electronic Application for Court Records” function, withdraw only the request for transcript, but not the remaining requests for court records as they may have been processed.

After submitting an electronic application for court records, how can an IU/OU know the fees required for his/her electronic application for court records?

If the application is approved by the Court and payment is required, a message for payment including the fees required for each requested court records will be sent to the applicant’s iCMS Message Box.

How to settle payment of an electronic application for multiple court records?

For the approved application in respect of multiple court records, all requested items under the same application will have to be paid together.

How can an IU/OU account holder settle payment of fees for court records by means of iCMS?

Payment of fees for court records may either be settled through online credit card or web-based PPS Shop&Buy Service (“PPSB”). For online credit card payment, iCMS will accept payment by Visa, MasterCard, China UnionPay and JCB.

Is there any payment ceiling for electronic payment?

The ceiling for online credit card payment is HK$3,300 for each transaction while the default maximum amount for PPSB as set by the service provider is HK$100,000. Payments over HK$3,300 but not exceeding HK$100,000 must be made through PPSB.

What should an IU/OU do if he/she does not have the electronic means (i.e. credit card or PPSB) to settle the prescribed fees, if any?

He/she may revert to the conventional mode (i.e. by paper application) for making the application for court records directly to the relevant Magistrates’ Courts. Please note that concessionary fees will not be applicable to application made by conventional means.

What should an IU/OU do if no payment is required for the application?

If the application is approved by the Court and no payment is required, he/she will receive an approval message from the e-Court in his/her iCMS Message Box. He/She will be notified again through his/her iCMS Message Box when all the document(s) of the application is/are ready.

Is there any acknowledgement information after payment is accepted?

A17

Yes. Acknowledgement information together with a payment receipt will be provided after payment is accepted by iCMS. An IU/OU may download the payment receipt for record.

An IU/OU account holder is advised to keep record of the acknowledgement information for reference or enquiry. In parallel, an acknowledgement message will be sent to his/her Message Box under iCMS for record.

What does an IU/OU need to do after payment?

A18

If the court records are ready, a message will be sent to his/her iCMS Message Box informing the court records are ready.

If he/she applies for electronic copy, he/she may go to the “Enquire Electronic Application for Court Records” function to download the document(s) within 28 days. The documents can no longer be downloaded after 28 days.

If he/she applies for hard copy, he/she may approach the Registry of respective case related Magistrates’ Courts for collection.
